Terms of Use

These Terms govern the FairTally website, calculator, and web, iOS, and Android apps (the “Service”), operated by Venture Melody LLC, doing business as FairTally. By using the Service, you agree to these Terms.

1. Using FairTally

FairTally helps households record expenses, agree on splits, and track balances. It does not transfer money or verify payments. You are responsible for the accuracy of your records and payments made outside FairTally. Calculator results are suggestions that may be rounded; review any split before applying it.

You must be at least 18. Provide accurate account information, protect your credentials, and report suspected unauthorized access. Only provide other people's information when you have a lawful basis to do so. Household members can see shared records and member information as described in our Privacy Policy.

3. Cancellation, restoration, and refunds

Manage web subscriptions through the household owner's billing settings in FairTally. Manage store purchases through Apple subscription settings or Google Play subscriptions. Uninstalling the app or leaving a household does not cancel a subscription.

Canceling renewal generally preserves paid access through the provider-confirmed period. Refunds, revoked purchases, billing failures, or account deletion may affect access sooner. Use Restore Purchases in the native app to recover an eligible purchase with the original store account.

Request store refunds through Apple or Google Play. For web refunds or billing help, email hello@fairtally.com. Cancellation does not itself request a refund. Refund eligibility follows applicable law and provider terms; mandatory consumer rights remain unaffected.

4. Account deletion

Request deletion in Profile → Privacy & Security or contact us. In-app deletion requires owners with other joined household members to transfer ownership first. This does not prevent you from emailing a request to exercise your data-protection rights. Shared history may remain for those members; see the Privacy Policy's deletion details, including photo removal.

If deletion removes a household with a Stripe subscription, that subscription must be canceled successfully before deletion completes. Account deletion does not automatically cancel Apple or Google Play subscriptions. Cancel through the original store to avoid further charges. Transferring ownership leaves household billing in place.

5. Acceptable use

Do not use the Service unlawfully, violate others' rights, harass or defraud anyone, send abusive invitations, attempt unauthorized access, or interfere with the Service. Do not scrape, copy, or resell the Service or its content without permission, except as permitted by law.

6. Disclaimers and liability

The Service is provided “as is” and “as available,” to the extent permitted by law. We do not guarantee uninterrupted or error-free operation or suitability for a particular purpose. FairTally does not provide tax, legal, or financial advice.

To the fullest extent permitted by law, FairTally is not liable for indirect, incidental, special, or consequential damages, or loss of data or profits, arising from your use of the Service. Total liability for a claim is limited to what you paid us in the preceding 12 months, or $100 if you have paid nothing. These limits do not exclude liability or consumer rights that cannot lawfully be limited.

7. Service changes and termination

We may change or discontinue parts of the Service with reasonable notice where practical, subject to your rights for paid services. We may suspend or terminate access for a breach of these Terms, unlawful use, or security threats, with notice where practical. Mandatory refund rights remain unaffected. Obligations intended to survive termination, including applicable payment obligations and liability limits, continue.

8. Changes to these Terms

We will communicate material changes and their effective date by email or a notice on the website or in the app, following any legal requirements for advance notice or agreement. Otherwise, continued use after the changes take effect means acceptance. If you disagree, stop using the Service and cancel any subscription.

9. General and contact

These Terms and applicable purchase terms describe your agreement with FairTally. The Privacy Policy explains our data practices; accepting these Terms is not consent to optional analytics. Nothing in these Terms, including liability limits or governing law, restricts your mandatory data-protection rights or remedies. If a provision is unenforceable, the rest remains in effect. U.S. and applicable state law govern these Terms without limiting your mandatory consumer protections.
